BASIC GOVERNING DOCUMENTS

Homes in a planned development (PUD) are common popular places to live these days and can offer numerous amenities such as security gates, private streets, clubhouse, pools, and fitness rooms that all the owners can use.

Because these common amenities must be maintained and regulated, each development is typically run by a homeowner's association, or HOA (see tab: HOA Structure for details of FDL HOA).

The HOA has a lot of power over homeowners' lives--but must also act in accordance with the terms and conditions contained in a set of governing documents that also applies to all owners in the HOA.

All HOA Directors MUST and all property owners should have a basic understanding of terminology used, what the governing documents are, and their purpose.

Although every development is different--as is every state--the governing documents typically include:
